TERMS OF SERVICE

1. SCOPE

These Terms govern access to the public functions of System HaSera and, where enabled, the subscription functions of Club HaSera. Mandatory consumer rights under German and European law remain unaffected.

2. PERSONAL LISTENING LICENCE

Access is granted solely for personal, lawful listening and use of the functions provided by the service. No ownership or intellectual-property rights are transferred.

3. CLUB HASERA ACCESS

A Club HaSera subscription provides the functions described for the selected plan during the paid access period. The current price, billing interval, principal service characteristics, contract duration, renewal conditions, and cancellation method must be displayed before a binding order is placed.

4. LISTENER TOKEN AND CREDENTIALS

Club access is connected to a pseudonymous Listener Token. The listener is responsible for safeguarding the Token, login, password, and recovery information. Credentials and subscription access must not be shared or transferred.

5. PAYMENT, RENEWAL, AND CANCELLATION

Payments and recurring billing are handled by the selected payment provider. A recurring subscription continues for the stated billing period until cancelled through the available subscription-management process. Cancellation stops future renewal; access ordinarily remains available until the end of the already paid period unless mandatory law or the payment provider's rules require another result.

6. WITHDRAWAL AND CONSUMER RIGHTS

Where a statutory right of withdrawal applies, the legally required information and procedure must be presented during checkout. Immediate access before the withdrawal period expires may require the listener's express request and any legally required acknowledgement.

7. AVAILABILITY

Maintenance, security work, technical updates, network conditions, browser restrictions, or circumstances outside reasonable control may temporarily affect availability. This does not exclude liability or remedies that cannot legally be excluded.

8. PROHIBITED USE

Unauthorized access attempts, credential sharing, circumvention of technical safeguards, extraction or redistribution of protected media, abusive automation, interference with the service, and unlawful use are prohibited. Access may be restricted where reasonably necessary to protect the service, rights holders, or other listeners.

9. LIABILITY

Liability is governed by applicable German law. Nothing in these Terms excludes liability where exclusion is prohibited, including liability for intent, gross negligence, injury to life, body, or health, or mandatory consumer guarantees.

10. GOVERNING LAW

German law applies, subject to mandatory consumer protections that apply in the listener's country of habitual residence. Mandatory rules concerning jurisdiction remain unaffected.
